These Terms and Conditions (“Terms”) govern your access to and use of the Krabi Moto Rentals website at krabimotorentals.com (the “Website”), your submission of booking and contact enquiries through the Website or our messaging channels, and the general framework under which we provide short-term motorbike and scooter rental services in Krabi Province, Thailand.
Krabi Moto Rentals (“we”, “us”, “our”) is a motorbike and scooter rental business serving international visitors and residents in Krabi. By accessing the Website, submitting an enquiry, communicating with us, or renting a vehicle from us, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, and any rental agreement or booking confirmation issued to you.
If you do not agree to these Terms, you must not use the Website or our rental services. We may update these Terms from time to time. The version and last reviewed date shown on this page indicate the current version. Material changes may be notified on the Website where appropriate.
These Terms are provided for transparency while certain operational and legal details are finalised. They do not replace a signed rental agreement or final terms agreed at handover. Sections marked for legal or operational review may be updated before publication as final customer terms.
In these Terms, unless the context requires otherwise:
**“Booking enquiry”** means a request submitted through the Website, WhatsApp, email, telephone, or other channel asking us to check availability or provide a quotation — it is not a confirmed reservation until we accept it.
**“Customer”, “you”, or “renter”** means the person who submits an enquiry, enters into a rental agreement, or uses a rented vehicle.
**“Rental agreement”** means the contract formed when we confirm a booking and you accept the rental terms at handover, including any written checklist, deposit receipt, or digital confirmation.
**“Vehicle” or “motorcycle”** means any scooter, automatic motorbike, maxi-scooter, or manual motorcycle rented from our fleet.
**“Security deposit”** means the cash deposit held during the rental period as security against damage, loss, late return, or other charges permitted under our policies.
**“Rental period”** means the agreed start and end date and time for the vehicle hire.
**“Third party”** means any person or entity other than you and Krabi Moto Rentals.
These Terms contain two related but distinct sets of provisions:
**Website terms** govern how you may use our Website, submit enquiries, and interact with our online content. They apply to all visitors.
**Rental terms** govern the hire of vehicles from Krabi Moto Rentals. A binding rental is created only when we confirm availability, agree pricing and dates, and you complete handover — not merely by browsing the Website or submitting a form.
Where a confirmed rental agreement or handover document conflicts with these Terms on a matter specific to that rental, the rental agreement prevails for that rental. The Website is intended for users aged 18 and over, or the age of legal majority in your jurisdiction if higher. By using the Website, you represent that you meet this requirement.
If you use the Website on behalf of a company, travel group, or another person, you represent that you have authority to bind that party to these Terms.
We may restrict access to the Website from certain territories where use would be unlawful. You are responsible for compliance with local laws applicable to you when accessing the Website from outside Thailand.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for personal, non-commercial purposes related to researching and requesting motorbike rentals in Krabi.
You may not copy, scrape, mirror, frame, deep-link to, or systematically download Website content except as permitted by law or with our prior written consent.
We reserve all rights not expressly granted to you. The Website and its content remain our property or that of our licensors.
You agree to use the Website lawfully and in good faith. Without limitation, you must not:
attempt unauthorised access to the Website, our systems, or other users’ data;
introduce viruses, malware, or harmful code;
interfere with the operation, security, or performance of the Website;
use automated tools (bots, scrapers, crawlers) to extract data or content without permission;
impersonate another person or submit false, misleading, or fraudulent information;
use the Website for unsolicited commercial messaging, spam, or unlawful solicitation;

We may suspend or terminate your access to the Website, refuse enquiries, or decline future rentals if we reasonably believe you have breached these Terms or pose a risk to our business, staff, or other customers.
Website content — including fleet descriptions, pricing guides, travel articles, route suggestions, insurance summaries, and delivery area information — is provided for general information only.
We make reasonable efforts to keep content accurate and up to date, but we do not warrant that all information is complete, current, or error-free. Motorcycle availability, prices, deposit amounts, delivery fees, and seasonal conditions may change without notice.
Photographs and specifications are representative. The vehicle supplied at handover may differ by model year, colour, or minor specification while meeting the agreed category and rental standard.
Travel guide and route content does not constitute personal safety advice. Road conditions, weather, traffic enforcement, and local regulations change. You remain responsible for your own riding decisions.
Submitting a booking request through the Website, WhatsApp, email, or telephone is an **enquiry only**. It does not guarantee availability, reserve a specific motorcycle, or create a binding contract until we explicitly confirm your booking.
We may accept, decline, or propose alternatives to any enquiry at our discretion — for example where a model is unavailable, licence requirements are not met, or delivery location is outside our service area.
A confirmed booking requires agreement on: rental dates and times; motorcycle category or model; pickup or delivery method and location; rental rate; security deposit amount; and applicable policies. Confirmation may be given by WhatsApp message, email, or in writing at handover.
You are responsible for providing accurate contact details, travel dates, accommodation information, and licence status. Incorrect information may delay confirmation or result in cancellation of a confirmed booking where we cannot reasonably fulfil the rental.

Published prices on the Website are indicative unless explicitly confirmed at booking. Final rental charges depend on motorcycle selected, rental duration, season, delivery distance, accessories, insurance options, and any agreed discounts.
A **cash security deposit** is required for most rentals. We do not take passports as deposit security. Deposit amounts and return procedures are explained at handover and in our Deposit and Payment Policy.
Rental fees, delivery charges, and extensions are generally payable in advance or as agreed at confirmation. The security deposit is separate and is not automatically applied to rental charges unless agreed in writing.
Accepted payment methods and currency are confirmed at booking. Unless otherwise stated, we operate primarily in Thai Baht (THB).
Late payment of agreed charges may affect your ability to extend a rental or hire again in future.
To rent a motorcycle or scooter, you must meet minimum age and licence requirements under Thai law and our rental policies for the category selected.
A valid motorcycle driving licence — Thai or internationally recognised equivalent — may be required depending on engine size and vehicle type. Licence verification is performed at handover.
Government-issued photo identification (such as a passport) and copies may be requested for contract and compliance purposes. We do not retain your passport as security.
We may refuse rental where we reasonably believe you lack adequate experience for the motorcycle selected, appear unfit to ride safely, have previously breached our terms, or fail to provide required documentation.
Rented vehicles must be used on public roads in accordance with Thai traffic law, road signs, and police directions.
Unless explicitly agreed in writing, prohibited use includes: riding under the influence of alcohol or drugs; racing or reckless riding; off-road or beach riding; use by an unauthorised driver; exceeding passenger limits; towing or carrying loads beyond the vehicle’s design; and use outside agreed geographic areas.
Geographic restrictions, daily distance limits, and ferry or island transport rules — if any — are explained at handover or in your rental agreement.
You are responsible for securing the motorcycle when unattended, including use of provided locks and parking in reasonable safety.
Traffic fines, parking penalties, and legal violations incurred during the rental period are your responsibility unless otherwise required by law.
Fuel level at handover and the expected return level are explained at collection. Returning the vehicle with less fuel than agreed may result in a refuelling charge.
Standard helmets are included with rentals where stated. Optional accessories — such as phone mounts, top cases, rain gear, or premium helmets — are subject to availability and additional charges as published on our Accessories page.
Lost, damaged, or unreturned accessories may be charged at replacement cost.
Basic third-party liability insurance may be included with rentals as required by Thai law and as described at handover. Coverage limits, exclusions, and optional upgrades are explained in our Motorbike Insurance information and at booking.
Insurance does not automatically cover all damage to the rented vehicle, theft due to negligence, off-road use, unauthorised drivers, or breach of rental terms. You remain responsible for damage, loss, and third-party claims to the extent not covered by applicable insurance or law.
In the event of an accident, theft, or damage, you must contact us promptly, cooperate with documentation, and follow our Damage and Accident Policy. Failure to report an incident may affect insurance coverage and deposit return.
The motorcycle must be returned — or made available for collection — at the agreed date, time, and location unless an extension has been approved in advance.
Extension requests depend on availability and must be agreed before the original return time. Additional rental fees apply for approved extensions.
Late returns may incur additional daily or hourly charges, affect availability for the next customer, and delay deposit return. See our Late Return and Extensions Policy.
Where hotel or villa collection is arranged, you must make the vehicle and keys available at the agreed time and location.
Cancellation terms depend on timing, season, and booking type. Please contact us as early as possible if your plans change.
Failure to attend an agreed handover without notice (“no-show”) may result in cancellation of the booking and may affect future booking eligibility.
Early return of a motorcycle does not automatically entitle you to a refund of unused rental days unless agreed in advance or required by applicable law.

We may suspend or terminate a rental immediately where we reasonably believe there has been a serious breach of these Terms or the rental agreement — including dangerous riding, substance impairment, unauthorised use, non-payment, or use of the vehicle in a criminal act — subject to applicable law.
Termination may involve recovery of the vehicle, forfeiture or deduction from the security deposit, and reporting to authorities where required.
By contacting us through the Website, email, WhatsApp, LINE, or other digital channels, you consent to receive communications electronically in connection with your enquiry or rental.
You agree that notices, booking confirmations, policy updates, and support messages sent by email or messaging apps satisfy legal communication requirements where permitted by law.
You are responsible for providing a working contact number and checking messages during your rental period.
All Website content — including text, photographs, graphics, logos, route descriptions, travel guides, pricing layouts, and software — is owned by or licensed to Krabi Moto Rentals and protected by copyright, trademark, and other intellectual property laws.
The Krabi Moto Rentals name, branding, and associated marks may not be used without our prior written permission.
You may print or save Website pages for personal reference in connection with a rental enquiry. Any republication, commercial use, or systematic copying requires our written consent.
Review excerpts displayed on our Website remain the property of the original platform and reviewer, used with permission or as permitted by the platform’s terms.
If you submit feedback, testimonials, photographs, or suggestions to us, you grant Krabi Moto Rentals a non-exclusive, royalty-free licence to use that material for customer service, marketing, and website improvement, unless you expressly limit that permission in writing.
You represent that you own or have rights to any material you submit and that it does not infringe third-party rights or contain unlawful content.
Public reviews posted on Google, TripAdvisor, or other platforms are governed by those platforms’ terms. Our responses to reviews will follow our internal review response guidelines and will not disclose private rental information.
Personal information collected through the Website, booking process, and rental handover is processed in accordance with our Privacy Policy, which forms part of these Terms.
By using the Website or renting from us, you acknowledge that we may collect and process identity documents, contact details, booking information, handover photographs, and communication records as described in the Privacy Policy.
The Website may contain links to Google Maps, review platforms, social media pages, insurance resources, and other external sites. We do not control and are not responsible for the content, availability, or privacy practices of third-party services.
Your use of WhatsApp, LINE, Meta, Google, and other third-party platforms is subject to those providers’ own terms and policies.
Opening an external link is at your own risk. The inclusion of a link does not imply endorsement unless expressly stated.
We aim to keep the Website available and secure but do not guarantee uninterrupted, error-free, or virus-free operation.
We may modify, suspend, or discontinue any part of the Website — including fleet listings, pricing, and booking tools — at any time without notice.
Scheduled maintenance, technical faults, or events outside our reasonable control may temporarily affect Website access.
To the fullest extent permitted by applicable law, the Website and its content are provided on an **“as is”** and **“as available”** basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Our total aggregate liability to you for claims arising from Website use (excluding claims relating to an active rental agreement, which are governed by the rental agreement and applicable law) shall not exceed the amount you paid to us for the specific booking enquiry or rental giving rise to the claim, or one thousand Thai Baht (THB 1,000), whichever is greater.
Some jurisdictions do not allow certain limitations of liability. In such cases, our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless Krabi Moto Rentals and its staff from claims, losses, fines, damages, and reasonable expenses (including legal fees) arising from: your breach of these Terms or a rental agreement; your use of a rented vehicle; your misuse of the Website; your violation of law or third-party rights; or false or misleading information you provide.
This indemnity applies to the extent permitted by applicable law and does not apply to losses caused by our wilful misconduct or fraud.
We are not liable for failure or delay in performing Website or rental obligations where caused by events beyond our reasonable control, including natural disasters, severe weather, pandemics, government restrictions, strikes, utility failures, or major transport disruption in Krabi Province.
In such circumstances we will use reasonable efforts to notify affected customers and propose alternatives where possible.
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law principles.
Subject to mandatory consumer protection rules in your home country that cannot be waived, the courts of Thailand shall have jurisdiction over disputes arising from these Terms or Website use.
We encourage you to contact us first to resolve any concern informally before commencing formal proceedings.
If you have a complaint about Website content, a booking enquiry, or a rental experience, please contact us promptly with your name, rental reference (if any), and a clear description of the issue.
We will acknowledge complaints within a reasonable time and investigate in good faith. Complex matters involving damage assessment, insurance, or traffic fines may require additional documentation and time to resolve.
Specific dispute resolution, arbitration, or mediation procedures may be added following legal review.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
Our failure to enforce any right or provision on one occasion does not waive our right to enforce it later.
For Website use, these Terms together with the Privacy Policy and Cookie Policy constitute the entire agreement between you and Krabi Moto Rentals regarding the Website.
For vehicle rentals, the signed or confirmed rental agreement, handover documentation, and referenced operational policies constitute the rental contract and prevail over general Website terms where they differ on rental-specific matters.
We may revise these Terms at any time. Updated versions will be posted on this page with a revised last reviewed date.
Continued use of the Website after changes are posted constitutes acceptance of the updated Terms where permitted by law. For active rentals, the Terms in effect at confirmation apply unless otherwise agreed.
